Memoirs that cover illegal activities  Reply with quote  

When someone publishes a memoir that includes information about things they did that were illegal, and that they have not been caught for, what potential legal implications are there? What if they write it under a fake name?

Might wanna find out about the statute of limitations for your particular offense-
if it's drugs, I wouldn't worry but they can always go after you for murder-
anything in between requires the input of somebody that actually gives a rat's ass about all things judicial...

Tots. No one is going to track you down for retroactive hoeing. (EG. Belle de Jour). You can always say you made shit up. The problem will be if there is evidence to corroborate your writing.

If there's art, jewels, a lot of money missing, or someone got killed, raped, or permanently fucked up in some way as a consequence of your actions, then it's probably best to leave that book unwritten.

As Zen said, someone has to have a reason to care. For instance, if your book implicated someone else. (You notice Belle isn't naming names.)


(By the way, spell check told me that's the way to spell hoeing, so I went with it. I'm not talking about things you do with a garden tool. Well, unless you roll that way, in which case, that might make for an interesting story.)

Oh yeah, a fake name won't protect you. If someone subpoenas your publisher or agent, then they have to give you up.

Look, no offense or anything, but I could so imagine this on one of those shows about really inept criminals ljile the guy who robbed his own bank and everyone recognized him or another guy who wrote the holdup note on one of his own checks or . . . Hey, this guy committed the perfect crime and then he wrote a book about it.

Yeah, it seems like the best thing to do would be to just write a Ramon a Clef and call it a novel.

No photos, no recordings, don't write anything down. Deny, deny, deny. I have my own mental list of statutes of limitations that I keep in the back of my mind. But even when those are up I don't intend to write about it. I don't see any real good coming from that.

That's the beauty of fiction. Different name, location, change the details, and roll with it. And always remember:
